RERA Complaint Process in Maharashtra — What Property Buyers Must Know 2026
What is RERA and Why Was It Introduced?
The Real Estate (Regulation and Development) Act, 2016 — commonly known as
RERA — was introduced by the Government of India to protect property buyers
from builder fraud, delays, and unfair practices.
Before RERA, thousands of home buyers in Maharashtra suffered losses due to:
- Builders delaying possession for years
- Selling the same flat to multiple buyers
- Changing building plans without buyer consent
- Taking full payment but never completing construction
Maharashtra was one of the first states to implement RERA through
MahaRERA — the Maharashtra Real Estate Regulatory Authority. Today,
any property buyer in Navi Mumbai facing a builder dispute can file
a complaint directly with MahaRERA.
When Can You File a RERA Complaint?
You can file a RERA complaint against a builder or developer in
Maharashtra if:
- Builder has delayed possession beyond the agreed date
- Builder has changed the building plan without your consent
- Flat area is less than what was promised in the agreement
- Builder is demanding extra money beyond the agreed amount
- Builder has not registered the project on MahaRERA
- Builder has sold you a flat that was already sold to someone else
- Construction quality is poor or defective
- Builder is not giving possession after full payment
If any of these situations apply to you — you have a strong RERA
case and should consult a RERA lawyer in Navi Mumbai immediately.
Documents Required for MahaRERA Complaint
Before filing a RERA complaint, gather these documents:
1. Sale Agreement / Agreement for Sale signed with the builder
2. Allotment letter issued by the builder
3. All payment receipts — showing amounts paid and dates
4. Possession letter (if promised but not given)
5. Brochure or advertisement where builder made promises
6. Any correspondence with builder — emails, letters, WhatsApp
7. Building plan copies (if plan was changed)
8. Bank loan documents (if home loan was taken)
9. Your identity proof — Aadhaar, PAN card
10. MahaRERA project registration number of the builder
Your RERA lawyer will help you organise these documents and build
a strong case.
Step by Step MahaRERA Complaint Process
Step 1 — Check Builder Registration
First verify if the builder's project is registered on MahaRERA.
Go to maharera.mahaonline.gov.in and search the project name.
Unregistered projects are a violation themselves and can be
reported directly.
Step 2 — Consult a RERA Lawyer in Navi Mumbai
Before filing, consult an experienced RERA lawyer. A lawyer will
assess the strength of your case, advise on the right relief to
claim (refund, possession, compensation or penalty) and prepare
your complaint properly.
Step 3 — File Complaint Online on MahaRERA Portal
Go to maharera.mahaonline.gov.in → Complaint Registration →
fill in your details, builder details, project details and
upload all documents. Pay the complaint filing fee online
(approximately Rs. 5,000 for individual buyers).
Step 4 — Complaint Number Issued
After filing, MahaRERA issues a complaint number. The builder
receives notice to respond within 30 days.
Step 5 — Hearing Before MahaRERA Authority
Both buyer and builder present their case before the MahaRERA
adjudicating officer. Your RERA lawyer represents you at all
hearings. Multiple hearings may take place over 2–4 months.
Step 6 — MahaRERA Order
MahaRERA passes an order — directing the builder to give
possession, pay compensation, refund the amount with interest,
or pay penalty. Orders are legally binding on the builder.
Step 7 — Execution of Order
If the builder does not comply with the MahaRERA order, your
lawyer can file an Execution Petition before MahaRERA to
enforce the order and recover your money.
How Long Does a MahaRERA Case Take?
A typical MahaRERA complaint in Maharashtra takes 3 to 6 months
from filing to final order. Execution proceedings may take an
additional 2 to 3 months if the builder does not comply
voluntarily.
What Relief Can You Get from MahaRERA?
MahaRERA can grant the following reliefs to property buyers:
- Full refund of amount paid with interest at 10.75% per annum
- Compensation for mental agony and financial loss
- Penalty on the builder up to 10% of project cost
- Directions to complete construction and give possession
- Cancellation of builder's MahaRERA registration
Can You File RERA Complaint Without a Lawyer?
Technically yes — MahaRERA allows self-representation. However,
builders always appear with experienced legal teams. Without a
RERA lawyer, buyers often make procedural mistakes, miss
important documents or fail to claim the right reliefs —
resulting in lower compensation or dismissed complaints.
An experienced RERA lawyer in Navi Mumbai significantly improves
your chances of getting maximum relief from MahaRERA.
